SMS Communications to End UsersWhen a homeowner submits a contact form or calls a business using Small Biz Flows, they may receive a single automated SMS acknowledgment from that business's dedicated tracking number, confirming their inquiry was received.The following disclosures apply to all automated SMS messages sent through the Small Biz Flows system:Opt-in: Submitting a contact form or placing a call to a Small Biz Flows-tracked number constitutes consent to receive one automated SMS acknowledgment per inquiry.
Message frequency: End users receive 1 message per inquiry. They will not be messaged again unless they initiate further contact.

To opt out: Reply STOP to any message. You will receive one confirmation, then no further automated messages.
For help: Reply HELP to receive support contact information.Mobile phone numbers submitted through contact forms or captured via inbound calls are used exclusively to operate the business's lead follow-up system. They are never shared with third parties for marketing or any unrelated purpose.3e. RetentionVoicemail transcripts and call recordings are retained for up to 90 days for quality and classification purposes, then deleted. Lead contact data (name, phone, message) is retained for up to 12 months after the client's service ends, then permanently deleted. Clients may request earlier deletion by contacting us.4. Client DataWhen a business signs up for Small Biz Flows, we collect:Business name, owner name, email address, and phone number
Escalation contact names and phone numbers
Website URL and form configuration details
Gmail OAuth access (read-only, filtered to specific lead notification sender addresses only — we do not access other email)We use this information to configure and operate your lead system. We do not sell or share client account information. We may reference your business category and general results (not your business name, unless you separately authorize it) in sales conversations or marketing materials, as described in your service agreement.5. Website VisitorsIf you visit smallbizflows.com, we may collect standard server log data including your IP address, browser type, referring page, and pages viewed. We use this only to understand site traffic and improve our web presence. We do not use third-party advertising trackers on our site.6. Third-Party InfrastructureSmall Biz Flows operates on top of industry-standard infrastructure providers. Data may pass through or be stored by the following services in the ordinary course of operating your lead system:

If there is a conflict between these Terms and a signed service agreement, the signed agreement controls.2. Description of ServiceSmall Biz Flows provides a done-for-you automation system that captures inbound leads from client websites and phone lines, notifies business owners by SMS, and escalates unanswered leads to designated backup contacts. The Service is delivered via a dedicated tracking phone number, automated SMS notifications, voicemail transcription, AI-assisted lead classification, and a simple text-command interface. No app or dashboard is required.
The specific features included in your Service are described in your signed service agreement. We reserve the right to add, modify, or deprecate features with reasonable notice.3. EligibilityThe Service is intended for use by legally operating businesses in the United States. By using the Service, you represent that:- You are authorized to enter into agreements on behalf of your business
- Your business operates lawfully and in compliance with applicable federal, state, and local laws
- You will use the Service only for legitimate business lead capture and follow-up purposes
- You are at least 18 years of age4. Your Responsibilities4a. Accurate InformationYou agree to provide accurate business information, owner name(s), phone number(s), and escalation contact details at setup, and to notify us promptly if any of this information changes. Missed leads resulting from outdated contact information are your responsibility.4b. Tracking Number UseYour dedicated tracking number is a lead attribution layer intended to be placed on your website contact page. If you choose to publish your dedicated tracking number on third-party directories (Google Business Profile, Yelp, Angi, etc.), please notify us first so we can account for it in your configuration. Be aware that if service is paused or cancelled, the tracking number will be decommissioned — any directories using it will need to be updated at that time.4c. Acceptable UseYou agree not to use the Service to:- Conduct fraudulent, deceptive, or illegal activities
- Spam, harass, or contact any person without their consent
- Circumvent or reverse-engineer any system component
- Use the Service for any purpose other than legitimate business lead capture and follow-up4d. Gmail OAuth ScopeIf you connect a Gmail account, you authorize Small Biz Flows to read only emails from specific lead notification senders (Angi, Yelp, Thumbtack, HomeAdvisor). This OAuth connection is read-only and filtered. You may revoke this access at any time through your Google account settings. Revoking access will disable the email lead channel but will not affect other Service features.5. SMS Messaging Terms5a. SMS Consent — Business Owners (Clients)By enrolling in Small Biz Flows and providing your mobile number during onboarding, you consent to receive automated SMS notifications from Small Biz Flows to that number. These messages include lead alerts, escalation notifications, and system updates. SMS notifications are the primary delivery method for the Service — without them, the core product cannot function.The following disclosures apply to all SMS messages sent to clients:- Opt-in method: You provide your mobile number during the onboarding process and execute a service agreement acknowledging that SMS notifications are the primary delivery mechanism. No separate keyword opt-in is required.- Message frequency: Varies based on lead volume. During active periods you may receive multiple messages per day. You will always receive at minimum one message per inbound lead. Message and data rates may apply.- To opt out: Reply STOP to any Small Biz Flows message. You will receive one confirmation message, then no further SMS. Note: Opting out of SMS will disable lead notifications and effectively pause the Service. To re-enable, contact [email protected].- For help: Reply HELP to receive a response with support contact information and the smallbizflows.com website.
You may also text the following commands at any time: PAUSE (pause escalations), BACK (resume), SWAP (change backup contact), STATUS (check system status), LEAD (retrieve last lead), REPORT (request monthly summary).5b. SMS Auto-Reply — End Users (Homeowners)When a homeowner submits a contact form or calls a home service business that uses Small Biz Flows, they may receive one automated SMS acknowledgment from that business's dedicated tracking number. This message confirms the inquiry was received and sets expectations for a callback.
The following disclosures apply to all automated SMS messages sent to homeowners (end users):- Opt-in: Contact forms on client websites include a disclosure stating that submitting the form constitutes consent to receive one automated SMS acknowledgment. Users who initiate contact by texting the tracking number consent by sending their first message.- Message frequency: 1 message per inquiry. End users will not receive further automated messages from this number unless they initiate contact. Message and data rates may apply.- To opt out: Reply STOP to any message. One confirmation will be sent, then no further automated messages.- For help: Reply HELP to receive the business's contact information and the smallbizflows.com support address.Mobile numbers collected from end users are used exclusively to send the automated acknowledgment and operate the lead follow-up system. They are never sold, shared with third parties, or used for marketing purposes.5c. Opt-In and Opt-Out RecordsSmall Biz Flows maintains records of SMS opt-in consent, including the method of consent (form submission, call, or signed service agreement), the date and time of opt-in, and the mobile number enrolled. Opt-out requests are processed immediately and recorded. These records are retained for the duration of the client relationship and for 12 months following termination.6. Fees and Payment6a. PricingCurrent pricing is $147/month following any applicable free pilot period. A one-time setup fee of $347 applies for non-pilot clients. Pilot clients who convert to a paid subscription have the setup fee permanently waived.6b. Billing
Subscriptions are billed monthly via invoice. Payment is due within 10 days of the invoice date. We reserve the right to adjust pricing with 30 days' written notice to active subscribers.6c. Late PaymentInvoices unpaid after 15 days may result in service suspension. Service will be restored within 24 hours of payment receipt. Accounts with invoices unpaid after 30 days may be terminated.6d. Pauses and Dormant HoldThe Service Pause and Dormant Hold structure is described in your signed service agreement. Free Pause is available for up to 2 consecutive months.7. Service AvailabilitySmall Biz Flows will make reasonable efforts to keep the Service operational and to resolve issues promptly. However, we do not guarantee uninterrupted availability. Outages may occur due to:- Scheduled maintenance (we will provide advance notice when possible)
- Failures or outages from third-party providers (Twilio, Make, OpenAI, Google)
Events outside our reasonable controlWe will notify you as promptly as practicable of any significant outage affecting your account.8. Data and PrivacyOur collection, use, and protection of data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:- Your lead data belongs to you. You may request a full export at any time.
- We do not sell or share your customers' data.
- We retain lead data for up to 12 months after service termination.
- Voicemail transcripts and recordings are deleted after 90 days.By using the Service, you represent that collecting and routing contact information through our system is consistent with applicable law and your website's privacy disclosures.9. Intellectual Property9a. Our PlatformSmall Biz Flows retains all rights in the Service, including the automation workflows, SMS templates, lead classification logic, and related technology. Your use of the Service does not grant you any ownership interest in our platform.9b. Your ContentYou retain ownership of your business information and lead data. You grant Small Biz Flows a limited license to process that information as necessary to provide the Service.9c. FeedbackIf you provide feedback or suggestions about the Service, you grant us the right to use that feedback without restriction or compensation.10. Disclaimers and Limitations10a. No Guarantee of Business ResultsSmall Biz Flows guarantees delivery and operation of the technical system described in your service agreement. We do not guarantee any specific number of leads, conversions, jobs booked, or revenue outcomes. We capture and route contacts — we do not generate them.10b. Warranty DisclaimerTHE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." SMALL BIZ FLOWS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.10c. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMALL BIZ FLOWS' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE TOTAL FEES YOU PAID IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IN NO EVENT WILL SMALL BIZ FLOWS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.11. IndemnificationYou agree to indemnify and hold harmless Small Biz Flows and its operators from any claim, loss, or damage (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or third-party right; or (c) inaccurate information you provided at setup that resulted in missed leads or other harm.12. Term and Termination12a. TermThese Terms begin on the date you first use or sign up for the Service and continue until terminated.12b. Termination by Either PartyEither party may cancel with 30 days' written notice (email to [email protected] is sufficient). You will be billed through the end of your current billing period. No refunds are issued for partial months.12c. Termination for CauseSmall Biz Flows may terminate your account immediately, without notice, if you: (a) use the Service in violation of applicable law; (b) engage in abusive behavior toward our team; or (c) fail to pay an overdue invoice after reasonable notice and cure period.12d. Effect of TerminationUpon termination: your tracking number will be decommissioned within 30 days; you may request a final lead data export; all data will be deleted within 12 months of termination. We will provide advance notice before decommissioning your tracking number so you can update your website.13. Changes to These TermsWe may update these Terms from time to time. We will provide active clients at least 30 days' written notice before any material changes take effect. Continued use of the Service after the notice period constitutes acceptance of the updated Terms. If you do not agree with a change, you may cancel before the effective date with no additional penalty.14. Governing Law and DisputesThese Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute arising from or related to these Terms or the Service shall be resolved in Scottsdale, Arizona.

General ProvisionsEntire AgreementThese Terms, together with your signed service agreement and the Privacy Policy, constitute the entire agreement between the parties regarding the Service and supersede all prior discussions, emails, and representations.
SeverabilityIf any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.No WaiverOur failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.No AssignmentYou may not assign or transfer your rights or obligations under these Terms without our prior written consent.
